Host Terms

1. Application

These Host Terms apply to every user who creates, organises, manages, or offers a game or sports activity through the Platform ("Host"). These Host Terms form part of the contractual framework between the Host and Tekkers and apply in addition to the Terms and Conditions.

2. Independent Host Status

Tekkers acts solely as a technology platform that facilitates connections and payments between participants and Hosts. Tekkers is not the organizer, operator or provider of any Event unless explicitly stated otherwise.

The Host remains solely responsible for the organization, delivery, safety and quality of the Event and for complying with all applicable laws, regulations and obligations relating to the Event.

3. Host Responsibilities

A Host is solely responsible for: (a) ensuring the accuracy and completeness of each listing; (b) ensuring the listed venue may lawfully be used for the advertised activity; (c) communicating relevant event details, changes, and cancellations clearly and in a timely manner; (d) maintaining a reasonable and lawful standard of safety; (e) complying with venue rules, local regulations, and any required permits; (f) treating all users fairly and respectfully; (g) complying with any tax obligations relating to amounts earned through the Platform.

4. Prohibited Host Conduct

A Host must not: (a) create fake or misleading games; (b) collect payments in a way that circumvents the Platform where prohibited by Tekkers; (c) discriminate unlawfully against participants; (d) create unsafe or knowingly unlawful events; (e) harass, threaten, or abuse users; (f) use the Platform to divert users to competing services in bad faith; (g) misuse personal data obtained through the Platform.

5. Venue and Safety

Hosts are responsible for confirming that the chosen venue is available, suitable, and lawful to use. Tekkers does not verify venue permissions on behalf of Hosts.

Hosts must take reasonable steps to reduce avoidable risks, including by accurately describing the game, keeping group sizes reasonable, and cancelling or amending an event where safety conditions make proceeding inappropriate.

6. Pricing and Payments

Where a Host charges fees, those fees must be accurately displayed through the Platform. Any applicable refund rules must be consistent with Tekkers policies or clearly disclosed where Tekkers permits host-specific variations.

Hosts may not impose hidden fees or request side payments in a misleading or coercive manner.

7. Payout Timing and Settlement

Host acknowledges that payouts are processed through Tekkers' payment service providers and may be subject to settlement periods, payout delays, reserves, reviews, or other risk-management measures. Tekkers may instruct its payment service providers to delay, suspend, or adjust payouts where reasonably necessary to: process refunds; resolve disputes, chargebacks, or payment reversals; investigate suspected fraud, abuse, or violations of these Terms; comply with legal, regulatory, or payment provider requirements; or protect Players, Hosts, Tekkers, or payment service providers from financial loss. Tekkers does not guarantee that funds will become available for payout immediately following an Event.

8. Chargebacks, Refunds and Negative Balances

Hosts remain responsible for all refunds, chargebacks, payment disputes, reversals, penalties, and other losses arising from Events they organize. Where such amounts exceed the Host's available balance, Tekkers and its payment service providers may recover the outstanding amount from future payouts or otherwise seek reimbursement from the Host.

9. Settlement Delay

Tekkers may apply a standard settlement delay before payouts become available. The current settlement delay may be up to eight (8) days following receipt of payment, although longer delays may apply where reasonably necessary under these Terms or under the requirements of Tekkers' payment service providers.

10. Identity Verification

To receive payouts, Hosts may be required to provide information and documentation requested by Tekkers or its payment service providers, including identity verification, business information and bank account details.

Failure to provide requested information may result in delayed payouts, suspension of payout functionality or removal from the platform.

11. Cancellations and Reliability

Hosts must cancel as early as reasonably possible if they cannot proceed with an event. Repeated cancellations, unreliable hosting, no-shows, or repeated complaints may lead to moderation measures, removal of hosting privileges, or suspension of the Host account.

12. Insurance and Liability

Tekkers does not provide automatic insurance for Hosts or participants unless expressly stated otherwise. Hosts are responsible for assessing whether they require their own liability insurance or other cover.

A Host may be personally liable for negligence, fraud, unlawful conduct, or breach of law arising from activities they create or manage.

13. Moderation and Enforcement

Tekkers reserves the right to suspend, restrict or permanently remove a Host from the platform where Tekkers reasonably believes that the Host:

Has engaged in fraudulent, deceptive or illegal conduct
Presents an unacceptable financial, legal or reputational risk
Generates excessive refunds, disputes or chargebacks
Breaches these Terms and Conditions
Fails to cooperate with verification or compliance requests.

Such action may be taken immediately where necessary to protect participants, Tekkers or its payment partners.

14. Data and Privacy

A Host may use personal data of participants only as necessary for the relevant event. A Host must not copy, sell, exploit, or reuse participant data for unrelated marketing or off-platform commercial purposes without a valid legal basis and without complying with applicable privacy law.

15. Governing Law

These Host Terms are governed by Dutch law. Disputes shall be submitted to the competent Dutch courts, without prejudice to any mandatory rights under applicable law.
